This end user agreement (the "Agreement") should be read by you (the "User" or "you") in its entirety prior to your use of Gradient B.V., located at Willemstad Heelsumstraat 51 E-Commercepark Unit 102, Curaçao ("INSANE" or "we"), and its services or products.
These Terms of Service ("Terms") govern your access to and use of the insane.gg website, applications and related services (collectively, the "Services"). By creating an account, accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Services.
Acceptance of terms
By using the Services you confirm that you have read, understood and accepted these Terms in full. We may amend these Terms from time to time. Your continued use of the Services after any change constitutes acceptance of the revised Terms.
Eligibility
You must be at least 18 years old (or the legal age of majority in your jurisdiction, whichever is higher) to register an account or use the Services. By using the Services, you represent and warrant that:
a. You meet the minimum age requirement;
b. You have full legal capacity to enter into a binding agreement;
c. You are not located in, or a resident of, any jurisdiction where the use of the Services is restricted or prohibited by applicable law;
d. You are not on any sanctions list and have not been previously suspended or removed from the Services.
Account registration
To use most features of the Services you must register through Steam. You are responsible for maintaining the confidentiality of your Steam credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.
Each user may hold only one Member Account. We reserve the right to suspend or terminate any duplicate or fraudulent accounts at our sole discretion.
Deposits and withdrawals
Deposits and withdrawals are processed via supported payment methods listed on the Services, including, where available, crypto currency and skin/item transfers. All transactions are subject to verification and may be delayed, refused or reversed where required by law, by our anti-fraud and AML controls, or by the relevant payment provider.
You are solely responsible for any fees, taxes or charges imposed by your payment provider, wallet or jurisdiction in connection with deposits and withdrawals.
Skins and items
Skins and in-game items used on the Services are owned and operated by their respective publishers (such as Valve Corporation). insane.gg is not affiliated with, endorsed by or sponsored by these publishers. We do not guarantee the availability of any specific skin or item, nor the validity of any third-party trade.
You are responsible for ensuring that your Steam account is correctly configured for trading, including a valid trade URL and the absence of any trade holds, bans or restrictions. We are not liable for any failed trade resulting from your account configuration or third-party platform changes.
Betting and gaming
All games and bets offered through the Services are governed by their own published rules. Once a bet is placed and confirmed, it cannot be cancelled, modified or refunded except as expressly provided in the relevant game rules or required by applicable law.
Game results are determined by provably fair algorithms and/or verified random number generators. You acknowledge that gaming involves risk and that you may lose the funds you stake. You agree to play only with funds you can afford to lose.
Prohibited activities
You agree not to:
a. Use the Services in violation of any applicable law, regulation or third-party rights;
b. Use any automated means, bots, scripts, scrapers or similar tools to interact with the Services;
c. Exploit any bug, error or unintended behaviour of the Services for personal gain;
d. Engage in collusion, chip dumping, match fixing or any other form of cheating;
e. Use the Services to launder money, finance terrorism or conduct any other illicit activity;
f. Harass, threaten or abuse other users, our staff or third-party providers.
Any violation may result in immediate suspension or termination of your account and forfeiture of any balance, at our sole discretion and without prior notice.
Responsible gaming
Gaming can be addictive. We encourage you to play responsibly and to set personal limits on time and money spent. If you believe you may have a problem, please seek assistance from a qualified support organisation in your country and contact us to request self-exclusion or account-limit tools.
Anti-money laundering
We operate an anti-money laundering and counter-terrorism financing programme in line with applicable regulations. We may at any time request additional documentation to verify your identity, source of funds and source of wealth. Failure to provide the requested information may result in account restrictions, including the suspension of withdrawals.
Intellectual property
All content provided through the Services — including trademarks, logos, designs, graphics, text, software and any other material — is the property of insane.gg or its licensors and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for personal, non-commercial purposes. Any other use is strictly prohibited without our prior written consent.
Third-party services
The Services may contain links to or integrations with third-party platforms (including Steam, payment providers and analytics tools). We are not responsible for the content, policies or practices of any third party. Your interactions with such third parties are governed by their own terms and conditions.
Suspension and termination
We reserve the right to suspend, restrict or terminate your access to the Services at any time and for any reason, including but not limited to suspected fraud, breach of these Terms, regulatory requirements or security concerns. Where reasonably practicable, we will give you notice; in cases of serious breach we may act without notice.
You may close your Member Account at any time by contacting customer support. Upon closure, any remaining balance will be handled in accordance with applicable law and our internal procedures.
Disclaimers
The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose and non-infringement.
Limitation of liability
To the maximum extent permitted by applicable law, in no event shall insane.gg, its directors, employees, partners or agents be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation loss of profits, data, goodwill or other intangible losses, arising out of or related to your use of (or inability to use) the Services.
Indemnification
You agree to indemnify and hold harmless insane.gg and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs and expenses (including legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any third-party right.
Governing law
These Terms shall be governed by and construed in accordance with the laws applicable to the entity operating insane.gg, without regard to its conflict-of-law principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts.
Changes to terms
We may revise these Terms at any time. The updated version will be posted on the Services with an updated "last revised" date. It is your responsibility to review the Terms periodically. Your continued use of the Services after any change constitutes acceptance of the revised Terms.
